The socialist mining ex-leader and ex-politician José Ángel Fernández Villa manoeuvred and used his power to influence in the decision to give" the Mining Widows and Orphans Fund "a subsidy drawn from the mining funds of almost 31 million euros". This is one of the assertions which appears in the complaint filed by the Anti-corruption Prosecutor´s Office in the investigation thanks to which it is meant to know the origin of the enrichment of Villa and the ex-president of the Mining Fund, José Antonio Postigo.

According to such complaint, there was "collusion" and a "agreed plan" among the 15 main culprits in the alleged plot of the "Hulla case" to "unlawfully profit from public funds" and "obtain massive amounts of money, later arising to the legal financial circuit".

Anti-corruption has also asked the Court of Instruction number 3 in Oviedo to investigate the authorities and civil servants who took part in those events for alleged misconduct in public service, bribery and embezzlement of public funds.

The Anti-corruption Prosecutor´s Office explains in its complaint that "the granting of the subsidy to the Mining Fund served, presumably, for the deviation and subsequent illegal profit of the defendants at the expense of the public funds". It adds that "the connivance got to such a extreme that long before being the subsidy granted, and being avoided all types of obstacles that prevented the legal development of the project, the Mining Fund had already chosen and hired the company which was going to execute de work, it had started without having resources to cover it and without the mandatory authorisations".

The investigation undergone by the anti-corruption prosecutors Ignacio Stampa y Carmen García Cerdá conclude that the construction license which authorised the building project for Felechosa´s nursing home was a must to grant the subsidy to the mining funds. However, the works started in May 2009 and the license was awarded in September 2010. By then 17 certificates of building works had already been issued.

Not only this. According to their account, Zapatero´s government passed to amend the decree which regulated the granting of mining funds eliminating the 1% limit despite the opposition of the State legal service and the Ministry of Industry technical secretariat. This decision had two crucial consequences. On the one hand, it was allowed to finance 100% of the project, and on the other hand, the Mining Regional Board, where the State, the Principality, SOMA, CC OO Mining Federation and the mining councils were, was given a "decisive" role, and not only to choose projects.

It was the Regional Board which agreed that for Felechosa´s nursing home 28,858,889 euros were allocated, amount which coincided with the one that appeared in the draft being presented to the Mining fund by Alcedo de los Caballeros construction company´s owner, Juan Antonio Fernández four months before, and which was endorsed by the architect Manuel Sastre. According to Anti-corruption, both had a close professional relationship, as the architect received from the constructor´s company at least 107,43.45 euros between 2004 and 2008.
